Distance Sales Agreement

Distance sales agreement covering the parties, applicable law, delivery, and return terms under Turkish consumer legislation.

This Distance Sales Agreement is concluded between Crescent Danışmanlık ve Proje Hizmetleri LTD. ŞTİ. (Hira Gurme brand) and the BUYER for orders placed electronically on https://www.hiragurme.com.

2. Parties — Buyer

The BUYER is the natural or legal person identified by the name, delivery address, phone, and email provided in the order form. Information declared at checkout is deemed accurate and attributable to the BUYER.

3. Subject

This agreement governs the sale and delivery of products ordered on the seller’s website and sets out the parties’ rights and obligations under Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

4. Products and price

Product type, quantity, price, payment method, and delivery details are as shown in the order summary and invoice/payment record. Prices are in Turkish Lira (TRY); taxes and any shipping fee are finalized at checkout. Where free shipping applies, the terms appear in the order summary; threshold amounts may change over time.

5. General terms

Before completing an order, the BUYER confirms they have reviewed the product essentials, price, payment and delivery terms, and this agreement. The order is transmitted to the seller upon payment confirmation (or order confirmation for cash on delivery). In case of stock or pricing errors, the seller may cancel and refund the order.

6. Payment

Online card payments are processed via iyzico using Visa, Mastercard, and other supported cards. Card details are not stored in the storefront. If cash on delivery is enabled, payment is collected upon delivery. Except for COD, an order is not final until payment succeeds.

7. Delivery

Orders are prepared after confirmation and handed to the carrier. Domestic deliveries usually complete within 2–4 business days. Tracking is emailed once dispatch begins. Delivery is made to the address provided by the BUYER. The seller is not liable for delays or extra costs caused by the BUYER’s absence or incorrect/incomplete address. Damaged or incomplete deliveries must be reported promptly via the Contact page on the website.

8. Right of withdrawal and returns

The BUYER may withdraw within 14 days of delivery without giving a reason and without penalty, subject to the Distance Contracts Regulation. Notice must be sent in writing via the Contact page on the website. Under Art. 15, withdrawal may not apply to perishable goods, food whose packaging has been opened after delivery, or products unsuitable for return for health/hygiene reasons. Eligible refunds are issued to the original payment method within the legal period after the goods return to the seller. See the Return Policy for details.

9. Governing law and venue

This agreement is governed by the laws of the Republic of Türkiye. Consumer Arbitration Committees and Consumer Courts at the BUYER’s domicile have jurisdiction under Law No. 6502; courts at the seller’s place of business also have jurisdiction.

10. Effectiveness

By completing an order on the site, the BUYER acknowledges they have read, understood, and accepted these terms. The agreement takes effect upon electronic acceptance.
